3. Licence to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable licence to download and use our applications on a device that you own or control, and to access our websites, for your personal, non-commercial use. This licence does not permit you to resell, redistribute, sublicense, or commercially exploit any part of the Services.

4. Intellectual Property

All content, features, and functionality within the Services — including text, design, graphics, logos, software, and underlying source code — are owned by or licensed to SYAG and are protected by applicable intellectual property laws. The SYAG and MINDFWRD names and marks are our property. Nothing in these Terms transfers any intellectual property rights to you.

5. Your Content

Some Services allow you to create and store personal content, such as journal entries or reflections ("Your Content"). You retain all rights in and ownership of Your Content. You grant us a limited licence to store, process, and display Your Content solely to operate and provide the Services to you. You are responsible for Your Content and for ensuring you have the right to use it.

6. Acceptable Use

You agree not to: use the Services for any unlawful purpose; attempt to gain unauthorised access to the Services or related systems; interfere with or disrupt the integrity or performance of the Services; reverse engineer, decompile, or disassemble any part of the Services except to the extent permitted by law; or use the Services to infringe the rights of others.

7. Third-Party Services and Links

The Services may link to, or integrate with, third-party websites or services not owned or controlled by SYAG. We are not responsible for the content, policies, or practices of any third party, and your use of third-party services is at your own risk and subject to their terms.

8. App Stores

Where you download our applications through a third-party app store or platform (such as the Apple App Store), your use is also subject to that platform's terms. You acknowledge that these Terms are between you and SYAG and not with the platform provider, and that the platform provider is not responsible for the Services. Where required, the platform provider and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. To the extent these Terms conflict with the platform provider's applicable end user licence agreement, that agreement governs with respect to the relevant application.

9. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure. Our Services support personal growth and wellbeing but are not a substitute for professional medical, psychological, or other advice. If you have concerns about your health, please consult a qualified professional.

10. Limitation of Liability

To the fullest extent permitted by law, SYAG shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Services. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law.

11. Indemnity

You agree to indemnify and hold harmless SYAG and its officers, employees, and partners from any claims, damages, or expenses arising out of your misuse of the Services or your breach of these Terms.

12. Accuracy of Materials

The materials within the Services are provided for general information and personal development purposes. We make reasonable efforts to keep them accurate and current but do not warrant that they are complete, accurate, or up to date at all times.

13. Changes to the Services

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice, and will not be liable to you or any third party for doing so.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

We may suspend or terminate your access to the Services at any time if you breach these Terms. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any dispute arising out of or relating to these Terms or the Services is subject to the exclusive jurisdiction of the courts of England and Wales.
